Bill Analysis

Under current law, an individual who qualifies may have their felony and misdemeanor charges expunged from their criminal history by a district court. This bill would allow individuals who have been arrested for an offense punishable by fine only to have their records expunged by a justice court or a municipal court. This bill would provide a procedure for people to file an ex parte petition for expunction for those previously mentioned offenses, and would establish a $100 fee for filing the petition.
