Relating to the payment of certain costs associated with certain assignments of a statutory probate court judge.

Bill Analysis

Under HB 1744 if a proceeding is in a county without a statutory probate court and if a party to a probate proceeding files a motion for a statutory probate court judge to hear a dispute related to the jurisdiction of a contested probate proceeding, a county may be reimbursed out of the estate for any amounts the county paid as compensation and expenses to the probate judge if the motion for assignment is granted. The order may be filed on the motion of the court, or on the motion of the party that filed the motion for assignment.   

If the statutory probate court judge does not order the reimbursement of the county from the estate, the party who requested the assignment would be required to reimburse the county for the amounts paid through compensation and expenses.

Vote Recommendation Notes

Though it is well within the proper role of government to set rules for the reimbursement for certain costs incurred by courts, the content of this bill does not have a measurable impact on out liberty principles and we will remain neutral.
