Bill Analysis
This bill modifies the power of courts of appeals and the power of a justice. Under current law, any court of appeals may issue a writ of mandamus to a judge in a district or county appeals court, and to certain courts of inquiry under the code of criminal procedure. If this bill passes, they may also issue a writ of mandamus to an associate judge who is overseeing certain family courts in the appeals district of the judge who appointed the associate judge.
Vote Recommendation Notes
It is well within the proper role of higher courts to issue writs of mandamus to courts who are acting against principles of law. However, this bill is mostly procedural and does not have a measurable impact on our liberty principles.
