Relating to the release of certain defendants pending a motion for new trial or an appeal from a misdemeanor conviction.

Bill Analysis

This bill would slightly modify the portion of the code pertaining to the release of a defendant on bond pending appeal. If a defendant has been convicted of a misdemeanor and is incarcerated pending the determination of their motion for a new trial, or for an appeal, they would be entitled to release after the completion of their sentence of confinement for their conviction. The court may require the defendant to give a personal bond but may not require any conditions on the personal bond, nor any other type of bail bond, nor a surety or other security.

For this bill’s role in addressing situations where individuals are unjustly confined in jail after the completion of their sentence, we support this bill. HB 1442 upholds our commitment to individual liberty.
