Bill Analysis

HB 1258 would authorize a person who establishes, maintains, or operates the state court document database for the supreme court to allow public access to a document filed with a court and included in the database if the database maintains each document in compliance with federal and state laws and a copy of each page clearly states that the copy is unofficial. The Supreme Court would be permitted to authorize the Office of Court Administration to establish, operate, and maintain the database. The Supreme Court would establish a fee for each page or part of a page accessed by a member of the public.

The provisions of this legislation clearly fall within the parameters of the legislatures's authority, however there is no discernible impact on our liberty principles and we remain neutral.
