Bill Analysis

HB 1183 would amend Local Government Code relating to the use of fireworks during certain times of the year. The bill would authorize county commissioners courts to prohibit the use of fireworks in an unincorporated area of a county.

 

The bill is permissive in its authorization of commissioners courts prohibiting the use of fireworks in these specific areas, which could exclude certain holidays from the prohibition and could create a permitting process for the use of fireworks. If enacted, violators of any rules implemented by the county commissioners would be subject to a Class C misdemeanor.

Vote Recommendation Notes

This legislation would grow government by giving county commissioners more regulatory authority and it would create a new criminal offense. This bills infringes on the principle of limited government. For these reasons we oppose HB 1183.
