Under current law, if an individual is arrested in a county other than the county in which an alleged crime was committed, and the court in the county that the crime was allegedly committed does not take charge of the individual within 11 days then that person would be discharged from custody.
HB 1177 would stipulate that instead of simply discharging the arrested person from custody, the magistrate in the county in which the person was arrested would release the arrested person on personal bond without sureties and forward the bond to the jurisdiction in which the crime allegedly took place.
Vote Recommendation Notes
It is well within the proper role of the courts to cooperate across jurisdictions to help ensure justice. However, HB 1177 is a procedural bill which does not appear to have an impact on our liberty principles, therefore we will remain neutral.
