Relating to sexual assault and domestic violence awareness continuing education for cosmetology license holders.

Bill Analysis

This bill would modify the continuing education requirements for the license to practice cosmetology. If this bill passes, the continuing education programs would have to include information on sexual assault and domestic violence. A licensed peace officer or a certified educator would be exempt from this requirement. The Texas Commission on Licensing and Regulation may waive this requirement if the commission determines that the completion of the program would cause substantial financial hardship, or if they are serving in the armed forces, or if they are incapacitated due to illness.

A person who has completed these requirements would be immune from civil and criminal liability for reporting a potential act of sexual assault or domestic violence, during the course and scope of their employment, if they made the report in good faith. 

Vote Recommendation Notes

This bill violates our free market and limited government principles by mandating additional training requirement for applicants for an occupational license unrelated to the profession. An occupational license should not be used as a means to force people to learn about sexual assault and domestic violence. We oppose HB 1104.
