Bill Analysis

Under current law the acts of buying and selling prostitution are conflated into one offense. This makes it difficult to parse out the statistics on buying and selling commercial sex. SB 825 would separate the two actions, the buying and the selling of commercial sex, into separate offenses committed by the separate actors (the buyer and seller).

Vote Recommendation Notes

SB 825 clarifies the penal code for administrative purposes and as such has no impact in changing the way individuals are prosecuted for solicitation. While these changes may help policymakers to get a better sense of the statistical data involved in the buying and selling of commercial sex, we are neutral on this bill, because it does not impact our liberty principles.
