Bill Analysis

SB 817 would change Family Code to add the phrase 'applicant for protective order' in addition to 'victim' concerning issuance of protective orders in case of abuse. The bill would also amend Family Code to add in additional definitions for 'family violence,' concerning the injury or emotional harm to children from pornography and/or controlled substances.

Vote Recommendation Notes

This bill would affirm the principle of personal responsibility, therefore we support this legislation.  SB 817 would allow prosecutors, parents, guardians, etc to apply for a protective order on behalf of the victim, therefore protecting the rights of victims to be free of abusive situations, particularly if the victim is a child. This also would help protect children from pornography or controlled substances.
