SB 69 would add Section 38.020 to Subchapter A, Chapter 38, Education Code that would require school districts and open-enrollment charter schools to notify parents if there is not a full-time nurse or the equivalent of a full-time nurse present on the campus. The equivalent of a full-time nurse would be defined to be if a school has two or more nurses assigned and their presence covers all the instructional hours of students. The notice would be required by the 30th day after school has begun if there is no full-time nurse presence and this notice can be satisfied by posting on the school website.

This bill would affirm the principle of personal responsibility, therefore we support this legislation. One aspect of the principle of personal responsibility is parental rights relating to responsibility for children. It would be imperative for parents (or legal guardians) to be aware if there is not a nurse present during school instructional hours, in case the child had a medical condition and would possibly need immediate medical care. This would allow them to address the issue and possibly make arrangements or notify the school.
