Bill Analysis

This bill seeks to create another exception under Chapter 72 of the Property Code for personal property assumed abandoned, in this case tangible property located on county land. The property in question would be considered abandoned if: the property is held by the county, the existence and location of the property owner is unknown, and if a claim has not been asserted to that property within 120 days. This is far less time than the other exceptions and a sharp decline from the current minimum of three years.   

Vote Recommendation Notes

This bill would allow for counties to auction off abandoned tangible personal property that is worth $100 or less if no claim is made on it within 120 days. SB 569 would increase personal responsibility by requiring individuals to lay claim on less valuable lost or abandoned items within a reasonable time frame. In turn this should help save county governments on storage costs and help clean up county land that is littered with abandoned property.
