Fiscal Notes

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government. 

Bill Analysis

SB 2027 seeks to create the Montgomery County Municipal Utility District No. 149 as a political subdivision of the State of Texas. The district will construct and finance water, sewer, drainage, road, and recreational facilities to serve property within the district, which is located in the corporate limits of the City of Conroe in Montgomery County. The district may issue bonds and levy ad valorem taxes. The district may not exercise the power of eminent domain. 

HB 4146 is an identical companion bill. 

The municipality must vote to approve the enactment of this legislation.

Vote Recommendation Notes

SB 2027 would provide the legislative requirement necessary to establish fundamental services in the area described in the bill as Montgomery County Municipal Utility District No. 149. The taxing and bonding authority given to the Montgomery County Municipal Utility District No. 149 only has local application. While this bill would create a new special purpose district, due to the local nature of this bill we are neutral on this legislation.
