Fiscal Notes

Based on the analysis of TDHCA and the CPA, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. 

Bill Analysis

SB 1658 seeks to create a study and report on the establishment of a franchise tax credit for the development of low income housing. The bill would direct the Department of Housing and Community Affairs (TDHCA), with assistance from the Texas Comptroller of Public Accounts (CPA) to conduct a study regarding the establishment of a franchise tax credit for the development of low income housing. 

Vote Recommendation Notes

SB 1658 would create a study and report on the development of a franchise tax credit for the development of low income housing. The mere study in itself is not particularly problematic, however we would oppose future legislation to create the type of tax credit that would be the subject of the study.

The state of Texas should be working toward complete abolition of the franchise tax rather than creating new exemptions to it for favored groups or projects. 

For these reasons we oppose SB 1658 on the principle of limited government.
