Bill Analysis

SB 1593 would allow a municipality to define and prohibit as a nuisance the sale or use of a firework or similar material only within the limits of the municipality.

Vote Recommendation Notes

While SB 1593 would restrict the sale or use of fireworks to only within the limits of the municipality, it would allow for fireworks to be exempt from the 5,000 feet bubble provision currently in statute. SB 1593 would lower local governmental restrictions on fireworks outside of the jurisdiction of the municipality. This bill would protect sellers (and users) of fireworks who operate outside of the city limits from being regulated by the city.

This legislation supports free markets, private property rights, individual liberty, limited government, and personal responsibility.
