Bill Analysis

SB 1222 would allow the Commissioner of Education to issue a subpoena during an educator misconduct investigation and file suit in the district court to enforce the subpoena for failure to comply. Supoenaed materials could be used against the educator in a disciplinary proceeding.

Vote Recommendation Notes

This bill would support personal responsibility on the part of the commissioner of education to more effectively investigate and, if warranted, dismiss or discipline teachers found guilty of misconduct. This bill would also support limited government by providing for a more effective and efficient investigation of alleged public school teacher misconduct which would lead to a quicker resolution of the situation for everyone involved. For these reasons we support SB 1222.
