Bill Analysis

HB 852 would establish an interim committee to study and review the methods by which state agencies store biometric identifiers. The bill would establish requirements and guidelines for the study and would require the committee to submit a report of the committee's findings and recommendations to the members of the Legislature not later than December 1, 2016.

HB 852 would require the Lieutenant Governor and the Speaker of the House of Representatives to appoint the members of the committee not later than the 60th day after the effective date of the bill. The bill would also require the Texas Legislative Council to provide any necessary staff and resources to the committee created by the bill.

Vote Recommendation Notes

HB 852 seeks to create an interim study of biometric identifier storage. While this is an important technological breakthrough in which the methods of protecting and securing sensitive personal data need to me determined, conducting interim studies foes not generally fall within the scope of our liberty principles and we are neutral on this legislation.
