Relating to the regulation of liquid propane gas tanks on residential property.

Fiscal Notes

No fiscal implication to the State or local governments is anticipated. 

The bill would amend the Property Code and Local Government Code to provide that a municipality or a county may not enact or enforce an order or ordinance that would restrict or prohibit a property owner from installing a liquid propane gas tank above the ground on the owner's property if the tank is a reasonable size to supply the residence. The bill would specify that a if a tank is located on residential property within the corporate boundaries of the municipality, the municipality could require the owner to screen the tank from view.

Vote Recommendation Notes

There shouldn't be regulations such as this on property owners associations, however, property owners associations shouldn't be restricting the private property rights of their residents. Due to this conflict we are neutral on this legislation.
