Bill Analysis

HB 511 would expand the definition of a correctional facility to cover any place designated for the detention of a person violating the Immigration and Nationality Act (e.g. an immigration detention center). 


This bill would also amend definitions related to correctional facility in the Code of Criminal Procedure Chapter on “Search Warrants.”

Vote Recommendation Notes

HB 511 would place individuals who are secured for violating the Immigration and Nationality Act under the same protections as anyone held in a correctional facility in terms of state statute. This means that officials holding them are subjected to an offense for violating the civil rights of those confined. However, this bill would not give those imprisoned for violating the Immigration and Nationality Act the same protections as American citizens in confinement. We support this bill for its attempt to create consistency among correctional facilities and detention centers, and for preserving the individual liberty of those in confinement.
