Bill Analysis

Currently, when an individual has had their driver's license revoked for certain offenses they are able to get a court order for an occupational driver's license.  The occupational driver's license allows the individual to drive to and from work.  Current law allows a copy of the court order to be used as a provisional license until the Department of Public Safety (DPS) issues the license.  HB 441 would allow a certified copy of the petition and court order to be used as a restricted license for 14 additional days beyond what current law allows.

Vote Recommendation Notes

HB 441 allows a greater period of time for individuals using a court order in lieu of a DPS-issued occupational driver's license to drive to and from work while they wait for DPS to issue the license.  This gives them the ability to continue to be responsible tax-paying citizens capable of going to their place of employment during the gap in time between when the court order is issued and when they receive the license from DPS.  We support HB 441 because it promotes personal responsibility, limited government, and individual liberty.
