Bill Analysis

HB 3914 would establish a procedure by which an individual who is believed to be incapacitated and subject to a court order concerning that incapacitation petition to have that set aside. The bill would establish a court procedure for investigating before a person loses any rights due to incapacitation.

Vote Recommendation Notes

This bill affirms the principle of individual liberty by protecting the rights of people who are allegedly incapacitated. This would prevent a person who is not actually incapacitated from having their legal rights removed. For this reason, we support HB 3914.
