Bill Analysis

The bill would amend the Health and Safety Code to increase the penalty for the offense of delivery of certain miscellaneous substances under the Texas Controlled Substances Act for certain circumstances from a class A misdemeanor to a state jail felony.

Vote Recommendation Notes

Existing law does not levy a sufficient enough penalty for a person who delivers to a child a controlled substance that's listed in the Commissioner of Health and Human Services' schedule, but which does not appear in the Texas Controlled Substances Act.

HB 3191 would boost the offense from a Class A misdemeanor to a state jail felony if 1) the actor was 18 years old or older, 2) delivered the substance to someone younger than 18 or enrolled in school. This has the effect of penalizing drug pushers who target school-age children -- a move we support under our personal responsibility principle.
