Bill Analysis

HB 3187 would modify the Local Government Code (Section 399) regarding water and energy improvements. Most of the changes introduced by the bill are clerical in nature and clear up the code, such as the replacement of the term “official” with “representative”. Marginally more substantive changes are made at the end of the bill regarding verification and contractual procedures.

The most significant addition is that of a new section (399.019) which limits personal liability. If enacted this section would provide that members of the governing body of a local government, employees of a local government, and board members, executives, employees, and contractors of a third party who enter into a contract with a local government under this section would not be personally liable as a result of exercising any rights or responsibilities granted under the section.

Vote Recommendation Notes

Most of the changes introduced by HB 3187 are clerical changes to language that do not affect our liberty principles one way or the other. As such, we are neutral on HB 3187.
