Fiscal Notes

The bill would amend the Insurance Code relating to increasing the amount of burial benefits required to be paid by an insurance carrier under the workers' compensation system. Based on information provided by the Texas Department of Insurance and the State Office of Risk Management, it is assumed that all duties and responsibilities necessary to implement the provisions of the bill could be accomplished within existing resources.

Bill Analysis

HB 3082 increases the minimum amount of workers’ compensation coverage for burial benefits from $6,000 to $10,000. The legislation requires insurance carriers providing workers’ compensation coverage to either pay the actual costs of funeral expenses or $10,000, whichever is less. 

Vote Recommendation Notes

We are neutral on HB 3082 because it makes changes to workers’ compensation, which is a state run program that forces workers to participate. Currently, workers’ compensation restricts an injured worker’s access to the courts to file a suit. Worker's compensation does not currently operate in a free market environment so these updated regulations do not infringe on our free market principle.
