Bill Analysis

HB 2852, if passed, would modify the Water Code (Subchapter C, Chapter 13) by adding two new sections (13.044 and 13.088) which deal with municipal fees charges to certain districts. Essentially, the bill would prohibit municipalities from charging special districts (namely school districts) fees based on the number of district students or employees. Rather, fees would be required to be based on the volume of retail water or sewer water processed by the municipally owned utilities in question.

Vote Recommendation Notes

HB 2852 is a prudent bill. It is indeed more equitable and sensible to establish fees based on volume of water processed as opposed to perhaps unrelated attributes of the districts in question. That said, the bill essentially manages the relationship between various government agencies and does not affect our principles one way or another. As such we are neutral on HB 2852.
