No significant fiscal implication to the State is anticipated. 

Bill Analysis

HB 281, if passed, would modify the Health and Safety Code (Subchapter C, Chapter 361) by adding a new section (361.1231) relating to landfill expansion requirements. Namely, all Type I landfills located within one municipality, yet controlled by a second municipality could not be expanded unless said expansion was first approved by the municipality in which the landfill is located. 

Vote Recommendation Notes

HB 281 seems like a prudent bill to balance property rights claims. Nevertheless, because the bill would also regulate interactions between two government entities, it does not, as a whole, positively or negatively affect our principles. As such we are neutral on HB 281.
