HB 2805, if passed, would modify the Water Code (Section
11.085(s)) regarding interbasin transfers. Currently any state owned water
taken from one river basin and transferred to another requires receiving a
water right, amendment to permit, or other official authorization. HB 2805
would waive this requirement if the transfer meets a certain set of criteria
regarding the types of transfer and the districts involved.
We recognize that water management is a legitimate function
of the state and that HB 2805 would grant slightly more flexibility to the
process of interbasin transfers. For this reason we support HB 2805.
