HB 2767, if passed, would make a number of changes to the
Water code (Section 36) regarding the administration of groundwater
conservation districts. The bill is relatively large, with numerous sections.
Most of the changes are relatively minor. The major substantive change would be
a significant addition to Section 36.3011 (Commission Action Regarding District
Duties). The new addition would add an inquiry process by which affected
persons could file a petition with the Texas Commission on Environmental
Policy.
“Affected persons” would be defined under this section and
include, among others, landholders in management areas, groundwater
conservation districts, regional water planning groups, those applying for
leases or permits, and parties with legally defined interests. Other changes
which would be introduced by HB 2767 regard territory adjustment via petition,
groundwater district management language, and the addition of a definition for operating
permits.
The changes that would be made by this bill are mostly clerical, administrative, or nonsubstantive with no discernible affect on our liberty principles.
