Bill Analysis
HB 2595 would amend the Local Government Code to prohibit a
municipality from holding an election proposed by a petition or
approving a petition requesting the repeal or enactment of an ordinance
if the repeal or enactment would restrict the right of a person to use
or access the person's private property for economic gain. A person
whose rights are affected by this violation may sue for injunctive
relief to enforce this section.
Vote Recommendation Notes
This bill affirms the principle of property rights by preventing local governments and individuals from infringing upon private property rights through a democratic process. For this reason, we support HB 2595.
