Bill Analysis

5/18/15 Update:
This bill is substantively the same as when we reported on it in its original chamber. We continue to support HB 2430. The second chamber sponsor is Senator Menendez.

Original chamber analysis below:

HB 2430 seeks to let privately owned and operated public swimming pools allow patrons to consume food or beverages while in the swimming pool.

Vote Recommendation Notes

HB 2430 would allow privately owned and operated swimming pools to operate swim up bars that serve guests who are still in the water. This bill allows private businesses to operate as they see fit without the unnecessary burden of regulatory penalties.

While the current regulations are generally not enforced, HB 2430 would protect these businesses from closure and penalties derived from a technicality. We support HB 2430 due to its protection of free markets from expansive government.
