The bill would amend Chapter 241 of the Health and Safety
code by requiring the Department of State Health Services (DSHS) to publish on
the DSHS website the final statement of deficiencies completed by DSHS and any
corresponding plan of correction submitted by a hospital that relate to an
inspection, survey, or investigation conducted under Section 241.051 (a). The
bill would prohibit DSHS from disclosing identifiable information concerning a
patient or health care professional on the website.
The purpose of the legislation is to enhance transparency regarding
hospital deficiencies while keeping identifiable information of a patient or
health care professional confidential. We support HB 2240 because it promotes
governmental transparency.
