HB 2185 would amend the chapter entitled “Search Warrants” within the Code of Criminal Procedure to reflect that a warrant for a DNA specimen may be executed in any county as opposed to only the county with jurisdiction as the law currently stands.
HB 2185 would violate due process rights for defendants who are the subject of a law enforcement request for DNA. It is not overly burdensome to seek and obtain a warrant from the proper jurisdiction. For this reason we oppose HB 2185.
