Bill Analysis

Summary: SB 1401 would ensure that companies who perform services in Texas but may need to send test results or do lab work outside of the state are properly reimbursed by the state Medicaid program and the Health and Human Services Commission. This would only apply when there is no in state facility capable of performing a necessary medical procedure.

Analysis: SB 1401 closes a loophole that can result in companies not being compensated properly. It is very common for large medical research companies to have different labs and perform different services in different states. There is no reason these companies should not be reimbursed for providing care to Texans. However, because this bill does not address any of our liberty principles, we will remain neutral.
