Bill Analysis

Summary: SB 1368 would require a nongovernmental vendor in a contract with a government entity to make a provision in the contract that submits the public information provisions of the contract to the requirements held under the public information statute. According to the committee bill analysis this would make "...the records of a private entity under contract with the state to provide goods or services should be subject to open records law to the extent those records are considered public information".

Analysis: SB 1368 would seek to provide transparency by requiring private entities to disclose public information related to contracts with government entities. Because a government entity is involved in the contract, public information as defined by Government Code 552.002 is subject to public disclosures as permitted under this statute. The information that is related to public funding in these contracts can be publicly disclosed due to the state's involvement. We are neutral on this legislation.
