Bill Analysis

Summary: HB 2447 would prohibit an individual from selling or advertising a device as a “fire extinguisher” or “portable fire extinguisher” unless that device has been recognized as such by the National Fire Protection Association (NFPA).

Analysis: HB 2447 would represent an increase in regulations on free enterprise. The NFPA does not own a trademark or copyright on the term “fire extinguisher” and an attempt to censor the marketing strategies of an individual or retailer is not consistent with limited government. Any device that can be used to put out a fire is, by definition, a fire extinguisher. Consumers have the choice to buy a device approved by the NFPA or not. We do not support this expansion of government.
