Bill Analysis

Summary: HB 2319 would prohibit a muncipality from adopting an ordinance or enforce an existing one that prohibits a church from providing overnight shelter to children. This bill would apply a muncipality's ordinances regarding the regulation of the operation of a homeless shelter to a church that shelters children. This bill would allow a muncipality to adopt ordinances regulating how long a child can be sheltered by a church and how many children can be sheltered at a church per night.

Analysis: HB 2319 promotes limited government by prohibiting a muncipality from telling a church that it cannot shelter children. However, this bill degrades personal responsibility by allowing a muncipality to dictate to a church how many children may be sheltered and how long children may be sheltered. We recommend amending HB 2319 to strike Section 215.006 (c) and (d) from Section 1 of the bill. Otherwise, we recommend voting YES on HB 2319.
