Bill Analysis

Summary: HB 2015 would require businesses that have contracted with the state on a project to properly classify their independent contractors and employees or be penalized $200 for every employee that is misclassified with a statute of limitations of three years. Under current law, if the business does not properly classify their employees, they are required to pay back taxes in unemployment benefits.

Analysis: This legislation deals with employee classifications for companies contracting with the state. Because of the numerous strings attached to state contracts, these are not normal free market transactions. None of our liberty principles are offended or uplifted by this legislation. We remain neutral.
