Bill Analysis

Summary: The Texas Property Code Chapter 215 was created in the previous legislative session to accommodate the unique combination of residential and commercial property within associations. HB 1824 modifies current law by eliminating duplications and conflicting information between the Property Code chapters. It provides specific points of clarity requiring 50% to vote for declarations or supplements, providing for attorneys to collect on their fees and costs, developing a process for reviewing books while protecting privacy, allowing owners to correct violations during a specified period, and providing the opportunity to have alternative payment schedules.

Analysis: HB 1824 functions within the appropriate scope of government by allowing the state to clarify language in statute that provides specific direction on the guidelines for mixed-use property owners' associations. By providing this clarity, property owners are able to interact with fellow members and the association itself, knowing the requirements. Furthermore, HB 1824 provides more flexibility in making payments. We support HB 1824.
