Summary: The compliance history program in the Texas Commission on Environmental Quality was designed to establish a rating system for businesses and industries to distinguish the good performers from the bad performers, as far as their compliance with TCEQ was concerned. HB 1714 would discontinue this program.

Analysis: The compliance history program has failed at determining good performers and bad performers. Small businesses are compared to some of the state’s largest businesses in a way that does not produce accurate portrayals of a company’s compliance. The program wastes the time, energy and resources of TCEQ. We support discontinuing the program.
