Bill Analysis

Summary: HB 1468 would allow communications under the Texas Workers' Compensation Act between an employer and insurance carrier to remain confidential. Exemptions relate to communications used as evidence in court, administrative violations, or statutorily required public records.

Analysis: HB 1468 would maintain the right of the employer to discuss private information with an insurance provider to assist with reconciling employee benefits. In essence, "...the inability to have a frank, confidential discussion between the policyholder and insurance carrier prevents the meaningful exercise of the employer's statutory rights to participate in the investigation and resolution of a workers' compensation claim" (Bill Analysis). We support HB 1468.
