Bill Analysis

Summary: HB 1013 would amend the Alcohol and Beverages code to make an individual liable for damages causes by an intoxicated minor to whom the individual provided alcohol. Currently, the law designates that a person is liable if the minor is “a minor under the age of 18.” HB 1013 would remove the “under the age of 18” language that would define minors as anyone under the age of 21.

Analysis: We believe that individuals between above the age of 18 are responsible for their decisions. This legislation would shift the burden from the person who commits the act to the person who provided alcohol. We do not believe that others should be held for the decisions of individuals who are older than 18. Existing code already provides penalties for providing alcohol to a person below the legal drinking age.
