Relating to hearing and public notice requirements regarding the purchase or conversion by a municipality of certain properties to house homeless individuals.
No fiscal implication to the State is anticipated.
SB 796 would require a public hearing and notice prior to a municipality purchasing or converting a property for the purpose of housing homeless individuals. The bill would also require a notice be sent by mail to residents within a two-mile radius of the proposed property no later than 36 hours before the public hearing. If the municipality fails to comply with the requirements of the public hearing, the bill would give an individual entitled to notice standing to bring an action against the municipality.
SB 796 would create greater government transparency by requiring a public hearing on a matter that impacts the homeowners in the proposed area of a purchase or conversion of a property into a housing for homeless individuals. Giving residents an opportunity to voice their support or concern for these types of projects promotes limited government, property rights, and individual liberty. For these reasons, Texas Action supports SB 796.
