Relating to the civil penalty for certain signs placed on the right-of-way of a public road.

Bill Analysis

SB 355 would increase the penalty for a person who places, commissions the placement of, or whose commercial advertisement is placed on a sign on the right-of-way of a public road and who did not receive prior authorization for the placement of the sign. The first offense would be $1000, the second, $5000, and the third offense would be $10,000. 

Vote Recommendation Notes

SB 355 would cap the violation fee for unauthorized placement of a sign in a right-of-way at $10,000. The law currently allows a maximum fee for a violation of $1,000. This would create a disproportionate expansion of government fees relative to the offense, even for repeat violations. For these reasons, Texas Action opposes SB 355.
