Bill Analysis

SB 30 would establish a legal process for individuals who own real property or an interest in real property to request that a county clerk remove from the property records any restriction relating to race, color, religion, or national origin that have since been deemed void and unenforceable. The bill also prohibits the court clerk from collecting a filing fee for filing the motion, and provides a sample form for filing the motion.

Vote Recommendation Notes

Texas Action supports SB 30 which uplifts individual liberty and private property rights by enabling property owners to do away with discriminatory deed restrictions which they do not wish to have associated with their property and which are legally void under Texas law.
