Relating to the provision of and professional liability insurance coverage for gender transitioning or gender reassignment medical procedures and treatments for certain children.
No significant fiscal implication to the State is anticipated.
SB 1311 would prohibit a physician from performing a surgery that sterilizes a child, performing a mastectomy on a child, prescribing, administering, or supplying medication that would induce transient or permanent infertility, or removing any otherwise healthy body parts or tissue. These actions would not be allowed for the purpose of transitioning a child's biological sex to match a perception of sex that is inconsistent with the child's biological sex.
SB 1311 would make exceptions for necessary gender reassignment procedures for children who are born with a medically verified genetic disorder or do not have the normal sex chromosome structure.
SB 1311 would allow the Medical Board to provide disciplinary actions against physicians who perform such procedures. SB 1311 would further prevent liability insurance policies from covering damages assessed against a physician or health care provider who provides a child gender transitioning or gender reassignment procedures.
