Relating to the exclusive jurisdiction of the state to regulate greenhouse gas emissions in this state and the express preemption of local regulation of those emissions.
No significant fiscal implication to the State is anticipated
SB 1261 would make it so that the state of Texas has exclusive jurisdiction over the regulation of greenhouse gas emissions within the state except as preempted by federal law. Additionally, the bill would forbid a municipality or other political subdivision from enacting or enforcing a regulation that directly regulates greenhouse gas emissions.
Texas Action supports SB 1261 as this bill limits government by restricting municipalities from overregulating greenhouse gas emissions and thereby promotes individual liberty.
