Bill Analysis

SB 1253 would require the Department of Public Safety to issue a license to carry a handgun to each applicant who meets all the eligibility requirements and submits all the application materials, regardless of whether the applicant may legally carry a handgun without a license in this state.

This is essentially a contingency bill to require DPS to continue processing license to carry applications and issuing licenses in the event that a Constitutional Carry bill is enacted allowing Texans to carry handguns in this state without needing a license. Many Texans may wish to maintain a valid LTC even if it is not required to carry in Texas so that they can maintain the ability to carry in other states that have reciprocity agreements with Texas, or for other purposes. 

Vote Recommendation Notes

Texas Action supports SB 1253 because it empowers individual liberty.  The bill would preserve the ability of Texans to obtain a License To Carry for reciprocal purposes with other states, even if the licensing requirement for the lawful carry of a handgun is eliminated in Texas.
