Estimated Two­year Net Impact to General Revenue Related Funds for SB1046, Committee Report 1st House, Substituted: a negative impact of ($798,000) through the biennium ending August 31, 2023.

The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

Bill Analysis

SB 1046 would ban the disposal or storage of high-level radioactive waste or spent nuclear fuel in the state of Texas except only for on-site storage by operating nuclear reactors and operating nuclear test reactors located on university campuses.

The bill would update regulations regarding low-level radioactive waste to make the regulations more consistent with current needs and to modernize the regulations to make them more relevant to current market conditions. 

Vote Recommendation Notes

Radioactive waste is highly regulated and Texas has a legitimate interest in ensuring that regulations both protect public safety and ensure that the highest and best use is made of existing waste facilities. Because we do not have a way to determine if this bill achieves those aims we will remain neutral on SB 1046. With that said, we do not see anything in this bill which contradicts our liberty principles.
