Bill Analysis

SB 1003 would require wind turbines to be constructed at a minimum distance of 3000 feet from an adjacent property if it is a non-participating property. The bill would allow the property owner the right to obtain a written waiver of the distance requirement in order to build a wind turbine within the setback. The waiver would only be valid for one year.

SB 1003 would also allow a county or district court to file an injunction to enforce the setback limit described above.

Vote Recommendation Notes

Texas Action supports SB 1003 because it empowers the property rights principle.  Wind turbines can drastically reduce property values by their mere presence and can cause damage to properties in extreme circumstances or after heavy usage. As such, it is within the state's remit to protect property owners from the negative effects of wind turbine construction projects.
