Relating to the liability of a landlord for damages resulting from the execution of a writ of possession in an eviction suit.

HB 900 would prohibit landlords from being held liable for any damages to personal property resulting from a police officer’s execution of a writ of possession.
Texas Action supports HB 900 because it would protect the private property rights of landlords after a successful eviction action. Once a court has determined that the landlord has full possession of a residence, the landlord should not be held liable for any damages done in a police officer’s reasonable execution of the eviction order. Such liability would erode the right to possession a landlord has over their property.
